Our purpose as a company is to design Generative AI that augments human intelligence, re-ignites our imaginations, and pushes the boundaries of what's possible. We're convinced technology can create a better world, and we commit to doing our very best, starting right here. There will be no fine print, buried traps, or hard-to-find cancel buttons. You have our word. While this is a legal document designed to protect both you and us, we've made the language accessible and clear. Our goal is to make the entire experience as human-centric as possible, including our legal requirements.
These Terms of Service ("Terms") form a contract between you and Curiouser.AI ("Curiouser," "we," "us," "our"). They apply to all users of Alice, including free trial and paid plan users. By using Alice, you agree to these Terms. If you do not agree, please do not use the service.
Alice is designed to augment your thinking. She is not a substitute for expert, professional, medical, legal, therapeutic, or financial advice.
1. What Alice Is (and Isn't)
Alice is "Reflective AI." She asks questions, helps you think, and builds context over time. She does not:
• Make decisions for you
• Pretend to be human
• Claim to know things you haven't shared
• Replace your own judgment
Alice enhances your intelligence; she does not replace it.
2. Eligibility
You must be at least 13 years old to use Alice. If you are under 18, you should have permission from a parent or guardian. These requirements reflect online safety laws for minors.
3. Your Account and Service Availability
We work hard to keep Alice available, but we cannot guarantee uninterrupted or error-free service. You can stop using Alice at any time. We may suspend or terminate your account if you:
• Violate these Terms
• Harm the service or other users
• Use the service in unlawful or abusive ways
• Are abusive toward our team
If we terminate your account for misconduct, we do not provide a refund. If we ever shut down the service entirely, we will refund any unused prepaid amounts.
4. Payments and Cancellations
If you choose a paid plan:
• You will be charged the price disclosed at signup.
• We will notify you before any price changes.
• You may cancel anytime; cancellations take effect at the end of the billing period.
• We do not offer refunds for partial billing periods.
• If your payment fails, we'll attempt to contact you before limiting access.
5. Privacy and Data Practices
We store your conversations so Alice can provide continuity and be useful over time. We protect your data using industry-standard security practices. We do not sell your data. We do not train public AI models on your personal content.
We may access your content only:
• If you ask us to (e.g., for support)
• If required by law
• If our safety systems detect potential harm
You may delete your conversations, and we will remove them within 30 days (backup systems may retain data briefly, but then it is deleted). Your data is hosted on reputable infrastructure providers.

6. Your Rights to Your Content
You retain ownership of the content you submit ("User Content").
To provide and maintain the service, you grant us a limited, worldwide, non-exclusive, royalty-free license to:
• Host, store, and process your content
• Display it back to you
• Use it to provide, secure, and support the service
• Generate aggregated, anonymized insights that do not identify you
We do not train public models on your User Content. We learn from patterns, not from reading individual conversations.
7. Acceptable Use
You are responsible for your use of Alice. You agree not to use Alice to:
• Commit unlawful acts
• Harm others
• Generate or distribute harmful content
• Interfere with the service or its security controls
• Reverse-engineer or copy the system
• Train or develop competing AI models
• Impersonate humans using AI output
If required by law, we may cooperate with law enforcement.
8. Technical Requirements
To use Alice, you need:
• A compatible device
• A stable internet connection
• A current web browser or app version
9. Third-Party Services
We may link to or integrate with third-party services (such as cloud infrastructure or login providers). We are not responsible for their content, actions, or terms. Please review their terms before using them.
10. Professional Disclaimers
Alice is not a licensed professional. She does not provide legal, medical, therapeutic, or financial advice. Always seek help from qualified professionals when appropriate.
11. Dispute Resolution (Informal First)
Before filing any formal claim, both sides agree to try to resolve the issue informally for at least 30 days.

12. Governing Law and Venue
These Terms are governed by California law, without regard to conflict of law principles.
Where court actions are permitted, the exclusive venue is state or federal courts in California, and you consent to jurisdiction there.
13. Warranty Disclaimer
Alice is provided "as is" and "as available." We do not guarantee:
• Uninterrupted service
• Accuracy
• Error-free operation
• That the service will meet your needs
To the extent allowed by law, all implied warranties are disclaimed.
14. Limitation of Liability
To the maximum extent allowed by law:
• We are not liable for indirect, incidental, consequential, or punitive damages
• We are not liable for lost profits, data, goodwill, or revenue
• Our maximum liability for any claim is the amount you paid in the prior 12 months
These limitations are essential to our agreement with you.
15. Indemnification
You agree to indemnify and hold Curiouser harmless from claims arising out of:
• Your violation of these Terms
• Your User Content
• Your violation of law or others' rights
16. Force Majeure
We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, war, terrorism, government action, labor disputes, or infrastructure failures.
17. Assignment
You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, restructuring, or sale of assets.
18. Changes to These Terms
We may update these Terms as Alice evolves. If we make material changes, we will notify you via the platform or email. If you continue using Alice after the effective date, you accept the updated Terms.
19. Severability and Waiver
If any part of these Terms is found invalid, the rest remains in effect. If we fail to enforce a term, it does not waive our right to enforce it later.
20. Entire Agreement
These Terms, together with our Privacy Policy and any applicable plan or order terms, form the entire agreement between you and Curiouser regarding the service.

We continually update Alice. Features may change or evolve over time.
